Effective Date: October 29, 2026

1. Agreement to Terms

By submitting an order form or paying an invoice for an infrastructure setup package from Unleash Action LLC ("Company", "we", "us", or "our"), you ("Client", "you") agree to be bound by these Terms of Service, our Acceptable Use Policy, and our Refund Policy.

This service is provided strictly for commercial B2B use and does not constitute a consumer transaction.

2. Scope of Technical Service

Unleash Action LLC provides a one-time technical configuration service ("Build – Handover – Exit") consisting of:

  • Registration of secondary domains.
  • Configuration of DNS authentication records (SPF, DKIM, DMARC, MX) and HTTP 301 redirects.
  • Creation of isolated mailboxes and initialization of automated warm-up.
  • Delivery of encrypted login credentials.
  • Provision of associated digital deliverables (Pre-Flight Technical Checklist, List Hygiene SOP).

3. Authorization & Account Handover

By submitting our Order & Onboarding Form, Client explicitly authorizes Unleash Action LLC to register domain names using Client's business details, accept standard third-party provider terms on Client's behalf, and provision administrative accounts.

Accounts are initially provisioned using a temporary administrative alias. At the point of Handover, Client receives the master login credentials for the domain registrar, mailbox provider, and warm-up tool accounts. Client assumes full responsibility to update the registrant details, master email, password, and billing information across all panels. Full ownership and administrative control transfer entirely to the Client at Handover.

4. Invoicing, Currency, Wire Fees & Turnaround SLA

  • Currency & Validity: All invoices are issued in United States Dollars (USD) via Wise Business and remain valid for 7 calendar days from issuance. Unpaid invoices expire automatically after 7 calendar days.
  • Cleared Funds & Wire Fees: Client is responsible for all sender, intermediary, or wire transfer fees. Provisioning does NOT begin until the full invoice amount has cleared in full in our Wise Business account ("Cleared Funds"). If intermediary bank deductions cause a shortfall, provisioning waits until the remaining balance is settled.
  • Turnaround SLA: The delivery SLA (Starter: 24–48 hours, Growth: 48 hours, Enterprise: 48–72 hours) begins strictly after BOTH (a) Cleared Funds are received in full and (b) Client has submitted complete onboarding details. Delays caused by banking rails, DNS propagation, or provider compliance are excluded.

5. Third-Party Billing & The 21-Day Card Rule

  • The setup fee covers the first year of domain registration and the first 30 days of mailbox and warm-up subscription costs.
  • Client is solely responsible for adding a valid payment method inside the provider panels before Day 21 (where Day 1 is the date of Handover) to ensure services do not pause at the end of the 30-day billing cycle. After this prepaid period, fees are charged directly to the Client by the providers. Unleash Action LLC adds no markup and collects no retainer.
  • Unleash Action LLC bears zero liability if third-party providers suspend services due to missing payment methods.

6. No Deliverability Guarantees ("As-Is")

Unleash Action LLC provides technical setup services "as-is". We guarantee DNS authentication at handover, but we provide NO inbox placement guarantees, open rate guarantees, or commercial sales outcomes. Newly registered domains require 14–21 days of automated warm-up before live campaigns.

7. 7-Day Technical Warranty & Refund Method

If any DNS records or mailbox configurations within our scope fail technical verification due to an error made by Unleash Action LLC, Client must notify us via our Contact page or [email protected] within 7 calendar days of handover. We will correct the error free of charge within 7 days of notification, or issue a full refund if the issue cannot be resolved. All eligible refunds under these Terms are returned via bank transfer (ACH, Wire, or Wise transfer) to the original sending bank account, net of any non-recoverable third-party wire or intermediary bank fees.

8. Indemnification & Limitation of Liability

Client agrees to indemnify and hold harmless Unleash Action LLC from any claims arising from Client's use of the infrastructure after handover (e.g., spam complaints, CAN-SPAM violations). To the maximum extent permitted by Wyoming law, Unleash Action LLC's total liability shall not exceed the total amount paid by Client for the specific setup order.

9. Governing Law & Modification

These Terms shall be governed by the laws of the State of Wyoming, USA, and exclusive jurisdiction shall reside in the state or federal courts located in Wyoming. We reserve the right to modify these Terms at any time; such modifications will only apply to orders placed after the effective date of the change.

10. Termination

We reserve the right to refuse or cancel any order prior to provisioning (in which case a refund of cleared funds, net of any non-recoverable intermediary wire fees, will be issued to the original sending bank account). Once provisioning has commenced, if Client violates these Terms or our Acceptable Use Policy, we reserve the right to suspend or terminate services immediately, without refund.
